Before placing an order, carefully read these Terms and Conditions and the Privacy Policy.

The content on the Website is for informational and educational purposes only and is not intended as a substitute for medical consultation. Always consult your doctor about the suitability of our advice and recommendations in light of your health condition.

By using the Website and placing an order you accept these Terms and Conditions.

Protection of personal data

The AB Beauty Professional online store guarantees the security of personal data and handles it in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation or "GDPR") and the Dutch Uitvoeringswet Algemene verordening gegevensbescherming (UAVG), as well as other applicable Dutch and EU data protection rules.

We will not pass on personal data to third or unauthorised persons except as described in this document. We undertake to permanently protect all personal data of the user and to use such data exclusively for:

  • processing and fulfilling your orders

  • communication regarding your orders, questions or complaints

  • sending newsletters and marketing messages if you have given your consent

  • fulfilling our legal obligations.

Data we collect

We may collect the following data when you use the Website or place an order:

  • first name and last name

  • billing and delivery address

  • telephone number

  • email address

  • order history and payment information (limited to what we need for invoicing and accounting)

  • date and time of access to the Website and IP address.

Legal basis and purpose of processing

We process your personal data:

  • because processing is necessary for the performance of a contract with you (for example to process and deliver your order)

  • because processing is necessary to comply with our legal obligations (for example accounting and tax rules)

  • based on your consent (for example for newsletters and marketing communication)

  • based on our legitimate interest in improving our services and preventing abuse or fraud.

We process personal data to communicate with you by email, SMS, telephone or other channels in order to process your order or respond to your questions or inquiries. If you subscribe to our newsletter, we use your email address to send you information about new offers and products.

Retention period

If you have consented to receive news from the online store, we store your email address until you withdraw your consent. Personal data entered when placing an order is stored for as long as AB Beauty Professional and the individual can assert legal claims against each other based on the concluded contract and for as long as required by applicable accounting and tax legislation.

After the retention period has expired, we permanently and effectively delete or anonymise the personal data.

Provision of data and disclosure to third parties

Providing personal data is voluntary. However, if you do not provide the data marked as mandatory at checkout, you cannot complete your purchase and we cannot deliver the goods or respond to your inquiries.

We may share your personal data with:

  • payment service providers and banks that process your payment

  • logistics and delivery partners (for example PostNL) for the delivery of your order

  • IT service providers who maintain our systems

  • professional advisers (for example accountants) if necessary to comply with legal obligations.

All such partners only receive data they strictly need and are bound by confidentiality and data protection obligations.

Your rights

You have the right to request access to your personal data, correction or deletion of your data, restriction of processing, data portability and the right to object to processing in the cases provided by law. You also have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

2. Shipping, delivery and availability of products

AB Beauty Professional strives to deliver your order as quickly as possible.

Orders placed on a business day before 16:00 (4:00 PM) are usually shipped the same business day. PostNL collects the packages from our warehouse every business day and takes them directly to the sorting center. In most cases, you will receive your package within 1 to 2 business days within the Netherlands.

We are not liable for delays caused by PostNL or other carriers, for example due to busy sorting centers or force majeure events.

Availability of products

It may sometimes happen that a product in your order is unavailable. We continuously monitor our online inventory, but in rare cases it may be discovered during order processing that a product is no longer in stock.

If a product is unexpectedly unavailable, we will contact you by phone or email to offer a suitable alternative or a refund. If we are unable to contact you, your order may be shipped the next business day without the unavailable item, and we will refund the amount of that item.

Shipping costs

For orders within the Netherlands under EUR 75 excluding VAT, a shipping fee of EUR 5.99 will be charged.

For orders within the Netherlands over EUR 75 excluding VAT, shipping is free.

If one or more products are returned and as a result the total value of the order falls below EUR 75 excluding VAT, the shipping costs that would originally have been charged will be deducted from your credit note.

Delays and investigation of shipments

Sometimes your order may be delayed by PostNL or another carrier. If your package has not arrived after several days, we can initiate an investigation after 7 business days from the shipping date. An investigation can take up to 12 business days. If the carrier cannot provide a definitive answer about the package, we will do our best to offer a suitable solution (for example replacement or refund), in accordance with applicable consumer protection rules.

For deliveries outside the Netherlands, delivery times and shipping costs may differ. The applicable costs and estimates are displayed at checkout.

3. Prices

All prices on the Website are listed in euros (EUR) and include applicable VAT unless explicitly stated otherwise.

Prices are valid at the time the order is placed and do not have a predetermined validity period. We reserve the right to change prices at any time, but such changes will not affect orders that have already been confirmed.

The purchase contract between AB Beauty Professional and the customer is concluded at the moment when we confirm your order by email ("Thank you for your order"). From that moment on, all prices and other conditions are fixed for that order.

4. Payment

Payment for products purchased through the Website must be made using one of the payment methods offered at checkout. The available methods may include, for example, iDEAL, credit or debit card, PayPal or other online payment services. The set of available methods can change from time to time.

You agree to provide current, complete and accurate purchase and account information for all purchases made through the Website.

We do not offer cash on delivery unless explicitly stated at checkout.

5. Complaint handling

If the order form has been successfully submitted, the Website will display a confirmation message and you will receive an email with the details of your order at the address you provided during checkout. If you do not receive this email, please check your spam folder and then contact us.

6. Purchase contract

The purchase contract between you and AB Beauty Professional is concluded when we confirm your order by email.

The purchase contract is concluded in English. Customer service is available in English, Dutch and Slovenian.

These Terms and Conditions form an integral part of every purchase contract concluded through the Website.

7. Security and protection of personal data

We use appropriate technical and organisational measures to protect the transfer and storage of personal data, orders and payments, including encryption technologies where appropriate and restricted access to systems.

We are committed to the careful and lawful use of personal data in our operations and to complying with the GDPR, the UAVG and other applicable data protection rules.

8. Identification of customers upon collection of products

We or our authorised delivery service reserve the right to appropriately verify the identity of the recipient of the ordered products (for example by checking an identity card or other documents), in order to ensure that we can hand over the products to the correct customer.

   

9. Returns of products and nonconformity

Upon delivery you should inspect the goods as soon as reasonably possible and check for any visible damages or discrepancies.

If you notice a defect or nonconformity, you must notify us within a reasonable period after you discovered or should reasonably have discovered the defect. In case of a visible defect on delivery, we recommend that you inform us as soon as possible.

Depending on the circumstances and in accordance with applicable Dutch and EU consumer law, you may be entitled to:

  • repair of the product

  • replacement of the product

  • an appropriate price reduction

  • or termination of the contract and a refund.

We are not responsible for defects or damages that are clearly caused by incorrect or negligent handling by the customer.

A complaint may not be accepted in particular if:

  • the goods were damaged due to improper or negligent use or handling

  • no proof of purchase (for example invoice or order confirmation) is provided

  • original labels or tags have been removed and the product shows clear signs of use beyond what is necessary to establish its nature, characteristics and functioning.

10. Limitation of liability

We strive to keep the Website available and accurate. However, we cannot guarantee that the Website will be accessible at all times without interruption or error.

We reserve the right to temporarily disable the Website or restrict access to it due to technical or other issues or maintenance. We are not liable for any indirect damage or consequential loss you may incur due to the temporary unavailability of the Website, insofar as permitted by mandatory consumer protection law.

Nothing in these Terms and Conditions excludes or limits our liability:

  • for death or personal injury caused by our negligence

  • for fraud or fraudulent misrepresentation

  • or for any other liability that cannot be excluded or limited under mandatory Dutch or EU law.

11. Applicable law and jurisdiction

These Terms and Conditions and all purchase contracts between you and AB Beauty Professional are governed by the laws of the Netherlands and applicable European Union consumer protection law.

In particular, Dutch rules on distance contracts and consumer protection in the Dutch Civil Code (Burgerlijk Wetboek), including provisions implementing Directive 2011/83/EU on consumer rights, apply to consumer purchases.

Any dispute that cannot be resolved amicably will be submitted to the competent court in the Netherlands. This does not affect any mandatory rights you may have to bring a dispute before another court under applicable consumer protection law.

12. Right of withdrawal (cooling off period)

If you are a consumer residing in the European Union and you purchase products online through the Website, you have the legal right to withdraw from the contract without giving any reason within 14 calendar days.

For products the withdrawal period of 14 days starts on the day you or a third party indicated by you (who is not the carrier) receives the product. If your order consists of several products delivered separately, the period starts on the day you receive the last product.

To exercise the right of withdrawal you must inform us of your decision to withdraw from the contract within the 14 day period by an unequivocal statement (for example by email). You can use a model withdrawal form if we provide one, but this is not obligatory.

Effects of withdrawal

If you withdraw from the contract:

  • you must return the products to us without undue delay and in any event no later than 14 days from the day on which you informed us of your decision to withdraw

  • you bear the direct cost of returning the goods unless we explicitly state that we will bear these costs

  • we will refund all payments received from you for the returned products, including the standard delivery costs (if any), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

During the cooling off period you may handle the product and packaging only to the extent necessary to establish the nature, characteristics and functioning of the product, similar to what you would do in a physical shop. You are liable for any diminished value of the goods resulting from handling other than what is necessary for this purpose.

The right of withdrawal may not apply to certain categories of goods, for example:

  • sealed products which are not suitable for return for reasons of health protection or hygiene and which were unsealed after delivery

  • products made to your specifications or clearly personalised

  • products that by their nature are inseparably mixed with other items after delivery.

If such exceptions apply we will clearly inform you about this before you place your order.
